Procedures for submitting copyright infringement notices and counter-notifications under the Digital Millennium Copyright Act.

Velynoriva respects the intellectual property rights of creators, software engineers, and researchers. In accordance with the Digital Millennium Copyright Act (17 U.S.C. ยง 512), we respond expeditiously to valid notices of alleged copyright infringement and maintain a clear process for evaluating counter-notifications.

1. Reporting an Alleged Infringement

If you believe that material hosted on or accessible through Velynoriva infringes a copyright you own or control, please submit a written notification containing each of the following elements:

  • Identification of the Protected Work: A clear description or list of the copyrighted work claimed to have been infringed, including a reference link or copy of the original material.
  • Exact Location of Disputed Material: The specific URL(s) and section heading(s) on Velynoriva where the alleged infringing material is located, sufficient to allow us to identify and review it.
  • Claimant Contact Details: Your full legal name, title or representative capacity, mailing address, telephone number, and verified email address.
  • Good-Faith Statement: A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Accuracy & Perjury Statement: A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Signature: A physical or valid electronic signature of the copyright owner or an authorized representative.

2. Where to Send a Notice

Please deliver your completed infringement notice to our designated editorial desk using either of the following channels:

  • By Online Form: Submit your notice via our secure Contact Page, selecting "DMCA / Copyright Inquiries" as the subject.
  • By Direct Email: Send your notice to editorial@velynoriva.my.id with the subject line "DMCA Infringement Notification".

Upon receiving a compliant notice, we review the claim against our original research archives. If the notice is substantiated, we take appropriate action, which may include disabling access to or modifying the contested material in accordance with applicable statutory conditions.

3. Responding to a Mistaken Removal (Counter-Notice)

If you believe that material you submitted or authored was removed or disabled as a result of mistake or misidentification, you may submit a formal counter-notification. Your counter-notice must be in writing and include:

  • Identification of the Material: Description of the material that was removed or to which access was disabled, and the specific URL location where it appeared before removal.
  • Your Contact Information: Your full legal name, physical address, telephone number, and email address.
  • Perjury Statement: A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Consent to Jurisdiction: A statement that you consent to the jurisdiction of the federal district court (or competent local court) for the judicial district in which your address is located, and that you will accept service of process from the person who provided the original notification or their agent.
  • Signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, we review the documentation and provide a copy to the original claimant. Unless the copyright owner initiates legal action seeking a court order within the statutory period, the material may be restored at our editorial discretion.
